Radon and the Ohio General Assembly

As often occurs during lame-duck-sessions in Congress and the Ohio Statehouse, there was a flurry of activity last week in Columbus as several potential amendments were added or removed from existing legislation.

One example included Radon Testing as an amendment to Ohio HB 442 which could have impacted Home Inspectors regarding Radon Inspection and Testing.

In response, a great deal of communication and REALTOR® Party Advocacy took place by OHIO REALTORS, the Cincinnati Area Board of REALTORS® and lobbyists from Ohio’s Home Inspectors and Radon interests.

Thankfully, in the end, an amendment to HB 442 was added, accepted and passed the Ohio Senate which will preserve Ohio’s Home Inspectors to continue performing Radon Inspection and Testing.

The legislation will now go back to the Ohio House for concurrence between the two chambers.  This could likely occur tomorrow, Tuesday December 22, 2020.

So, as is also often the case in these lame-duck-sessions, we will wait to see the outcome, but for now, it appears that REALTORS® and Home Inspectors can view this as a victory.
